Adverse possession is the process by which title to another's real property is acquired without compensation, by a possessor who is holding the property in a manner that conflicts (is adverse) with the true owner's rights and has adversely possessed the property for a statutorily mandated period of time. In essence, adverse possession is the manner by which an individual acquires legal title to land through occupancy. In Washington, the legal standard for adverse possession is that an individual may acquire a right to the property of another person if the adverse possessor occupies the land for over ten (10) years, and does so openly, continuously, exclusively, actually, and without permission from the true owner. Adverse possession can occur to an entire parcel of land or it may affect only a portion of the property.
