Seattle Probate Attorneys

It is critical that every adult have a will or other means to control the way in which their property and personal assets are distributed.  This is especially important if you are married, have children, or own a small amount of personal assets or property.  Even if you are single, ensuring that the property and assets you have worked hard to acquire are properly disposed of is vital.

Dickson Frohlich Understands the Probate Process

Probate is the legal process of transferring property upon a person’s death.  Although probate laws have changed over time, the purpose of probate has not.  Through probate, people formalize their intentions as to the transfer of their property at the time of their death, arrange for certain debts to be paid from the estate, and establish the manner in which their property is to be distributed.

How Does Probate Administration Work in Seattle?

The probate process is a court-supervised process designed to facilitate the transfer of a person’s property at death.  You may be familiar with the term “probating a will.”  This describes the process by which a person shows the court that the decedent followed all legal formalities in drafting his or her will.  In Seattle, the probate process usually takes six months to a year.[1]

What Happens in Probate?

The probate process may be contested or uncontested.  Most contested issues generally come about when an heir is not satisfied with their share of the decadent’s property.  Some of the common arguments raised when the probate process is contested include:

1.      Improper influenced of decedent in making gifts

2.      Decedent lacked the proper capacity to make a will

3.      The necessary legal formalities in drafting a will were not followed.

While contested probate issues can become serious, lengthy legal battles, the majority of probated estates are uncontested.  The basic process of probating an estate includes:

1.      Collecting all probate property of the decedent

2.      Paying all debts, claims, and taxes owed by the estate

3.      Collecting all rights to income, dividends, etc.

4.      Settling any disputes

5.      Distributing or transferring the remaining property to the heirs
