The Mediation Process

Mediation is a form of alternative dispute resolution (ADR) that involves the adverse parties and a neutral third party known as the mediator. The mediator is trained to guide interactions and negotiations between the parties while promoting compromise and reconciliation in an attempt to reach a settlement without needing litigation. Mediation is often used in legal disputes such as the following:

If a settlement agreement is reached in mediation proceedings, the case may be resolved, though it is up to the parties to abide by the mediation agreement. This is because mediation agreements are not legally binding. In some cases, if one party does not follow the mediation agreement, the case may end up back in court for a legally binding resolution. However, there are many benefits to at least attempting mediation first, since it is faster and more cost-effective than litigation.
